These Terms of Service ("Terms") govern your access to and use of Nexforum's forum hosting services, website and related tools (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. Please read them carefully before signing up.
By accessing or using Nexforum (nexforum.net), you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement and agree to be bound by these Terms and our Privacy Policy.
If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms, and references to "you" in these Terms apply to both you personally and that organisation.
If you do not agree to these Terms, you must not use the Service.
Nexforum provides web hosting services specifically designed for forum software communities. The Service includes:
The Service is provided on a shared hosting basis. Nexforum reserves the right to modify, suspend or discontinue any aspect of the Service with reasonable notice except where immediate action is required for security or legal reasons.
To use the Service you must create an account by providing accurate, complete and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at hello@nexforum.net if you become aware of any unauthorised access to your account.
You may not create an account using a false identity, impersonate another person or entity, or use the Service if you have previously been suspended or terminated from using it.
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use of the Service.
You are responsible for all content hosted on your forum, including content posted by your forum's members. You must ensure that your forum complies with all applicable laws in your jurisdiction and in Canada (where our servers are located).

Discovery of prohibited content may result in immediate suspension of your account without prior notice. We will cooperate fully with law enforcement authorities in connection with any investigation of prohibited content.
Nexforum offers a 30-day free trial that requires no payment information. After the trial period, continued use of the Service requires a paid subscription at £0.99 per month ("Subscription Fee").
Billing is processed monthly in advance via Stripe through the ClientExec billing portal. You authorise Nexforum to charge your payment method for the Subscription Fee on a recurring monthly basis until you cancel.
All prices are stated in British Pounds Sterling (GBP) and are inclusive of any applicable taxes unless otherwise stated.
Nexforum reserves the right to change the Subscription Fee with at least 30 days' written notice to your registered email address. Price changes will not affect your billing until the notice period has elapsed. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.
Payments are processed by Stripe. Your payment card details are stored and processed by Stripe in accordance with their privacy policy and PCI-DSS compliance standards. Nexforum does not store your full card details.
You may cancel your Nexforum subscription at any time through your ClientExec billing portal. Cancellation takes effect at the end of your current billing period — you retain access to the Service until that date.
Nexforum does not provide refunds for partial months or unused portions of a paid billing period except where required by applicable consumer protection law.
Upon cancellation, your hosting account and its contents will be scheduled for deletion after a grace period. We strongly recommend exporting your forum database and downloading your files before cancelling. Nexforum is not responsible for data loss following account cancellation.
If you cancel during your free trial period, no charge is made and your account is closed immediately.
Nexforum performs automated daily backups of hosting account data as a convenience feature. These backups are maintained for operational purposes and are not guaranteed to be available in all circumstances.
You retain full ownership of all data, content and files stored in your hosting account. Nexforum does not claim any intellectual property rights over your content.
You grant Nexforum a limited, non-exclusive licence to store, copy and transmit your content solely for the purpose of providing the Service to you.
Nexforum may access your account data only where necessary to provide technical support you have requested, to investigate abuse reports, to comply with legal obligations or to maintain the security and integrity of our systems.
The Nexforum name, logo, website design and proprietary software are owned by Nexforum and protected by applicable intellectual property laws. You may not use our trademarks or branding without our prior written permission.
The forum software platforms available through Softaculous (phpBB, MyBB, SMF, FluxBB, Vanilla Forums, PunBB, bbPress, Flarum and others) are the intellectual property of their respective owners and are licensed under their respective open-source licences. Nexforum does not claim ownership of any third-party software.
You represent and warrant that you own or have the necessary rights to all content you upload to your forum and that such content does not infringe any third-party intellectual property rights.
To the fullest extent permitted by applicable law, Nexforum's total liability to you for any claim arising from or related to these Terms or the Service — whether in contract, tort (including negligence) or otherwise — shall not exceed the total Subscription Fees paid by you in the three months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Nexforum reserves the right to suspend or terminate your account, with or without notice, if:
Where possible and where the situation permits, we will provide advance notice before suspension and a reasonable opportunity to remedy the breach. In cases involving prohibited content, security incidents or legal requirements, suspension may be immediate.
Upon termination, your right to use the Service ceases immediately. Sections 8, 9, 10, 12 and 13 of these Terms survive termination.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and notify you by email to your registered address at least 14 days before significant changes take effect.
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must cancel your account before they take effect.
For minor changes (such as corrections of typographical errors or clarifications that do not materially affect your rights), we may update the Terms without advance notice.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer resident in another jurisdiction, you may also have rights under the laws of your local jurisdiction that these Terms cannot override.
